Gov't awaits Court of Appeal's ruling on Highway Extension
The Ministry of Works and Transport (MOWT) and the National Infrastructure Development Company (NIDCO) Limited says it will await the outcome of the Privy Council’s decision on the halting of works on the Toco-Manzanilla highway.
On Friday, the Court of Appeal granted the Fishermen and Friends of the Sea (FFOS) conditional leave to apply to the Privy Council to appeal its decision on March 26, which ruled in favour of the Environmental Management Authority (EMA) and MOWT.
The Court of Appeal has taken the decision that an injunction is reinstated to preserve the status quo pending the hearing and determination of the matter at the Privy Council. This means that NIDCO must suspend all on-going works on the project at this time.
The Court of Appeal has mandated the FFOS to make an application to the Privy Council for an expedited hearing of its application given the urgent and critical nature of the case and its impact on the rights of the State and third parties.
