Radio station ordered to pay Junior Sammy $450K for defamation
The High Court has ordered radio station 104.7 More FM to pay businessman and contractor Junior Sammy $450,000 in compensation for defamation over statements made on the talk show programme, Ground Report, between November and December 2016.
Justice Frank Seepersad delivered the 36-page judgement on Wednesday.
In 2016, Sammy and his companies, Junior Sammy Contractors Limited, Jusamco Pavers Limited and Sammy Multilift Services filed an injunction in the High Court against 104.7 More FM and hosts of the Ground Report, Andy Williams and Lennox Smith.
The injunction sought to prevent the radio talk show hosts from broadcasting certain defamatory statements, in which it was alleged that company was corrupt.
In delivering his judgement, Justice Seepersad ruled that the statements were indeed defamatory and ordered the radio station to pay the contractor $450,000 in compensation.
Seepersad added that the law needs to reviewed, noting that there are several call in programmes where persons regularly make defamatory statements.
“The law in this jurisdiction needs to be reviewed especially given the fact that talk shows have become the norm and there are numerous call in programmes where persons regularly make highly and offensive defamatory statements,” he said.
