Retrial set for Machel Montano, Kernal Roberts

The Court of Appeal has granted a retrial to soca sensation Machel Montano and Producer Kernal Roberts in their challenge of their 2013 convictions.

Montano was found guilty of assaulting Gerard Bowrin, Janelle Lee Chee, Brandis Browne and Russell Pollonais while Roberts was found guilty of assaulting Browne and Pollonais. Montano was ordered to pay compensation totaling $13,500 and fines in the sum of $13,700 while Roberts was ordered to pay $11,000 in compensation and $13,000 in fines.

Magistrate Maureen Baboolal-Gafoor delivered the judgement in 2012, however, her failure to give written reasons for her decision when she convicted them and freed fellow Soca artists Joel “Zan” Feveck and Rodney “Benjai” Le Blanc of the crime was grounds for the appeal.

Montano's attorney Jagdeo Singh argued that Baboolal-Gafoor’s reasons were required as they would show the Appeal Court how she analysed the law and the evidence in the case to arrive at the verdicts.

As a result of the ruling, both Montano and Roberts were granted a fresh bail of $50,000 each.
